Acceptance of Policies
These policies apply to products and services provided by One Step Services unless different terms are expressly stated in a written quote, proposal or agreement. When these policies are linked or referenced in an order, quote, proof, invoice, email or online ordering system, your approval of a proof or other authorization to proceed constitutes your acknowledgment and acceptance of the policies applicable to that order. Approval of a proof also authorizes One Step Services to begin production and, when applicable, mailing or fulfillment based on the approved proof and order specifications.
Turnaround Times
Our turnaround time for direct mail is typically 1-3 business days after final proof approval and receipt of all information, data, payment and materials required to produce the order. Depending on the scope of the job, production volume, equipment availability, vendor availability or other circumstances, additional time may be required. We reserve the right to take additional production time when circumstances are beyond our reasonable control. Production turnaround does not include USPS or other carrier delivery time.
*NOTE: Turnaround times are estimates and are not guarantees. We understand the importance of timely production and will make commercially reasonable efforts to process orders as quickly as possible. Time-sensitive requirements should be communicated to our Customer Service staff before an order is placed or approved so that we can determine whether the requested schedule can reasonably be accommodated.
Our turnaround time for non-mailed products varies depending on quantity, material, finishing, production method and other factors related to commercial printing and fulfillment. Any completion or delivery date provided by One Step Services is an estimate unless we expressly agree otherwise in writing.
PROOFING PROCESS & COLOR MATCHING
Electronic and screen proofs are intended primarily to confirm content, layout, position and general appearance. Color shown on a monitor, mobile device, office printer or other non-contract proofing device is only an approximation of printed color. Color appearance varies based on screens, device settings, surrounding lighting, paper, coating, ink, printing process and other production factors. Color and ink density on an approved screen proof may vary from the finished printed product. A color match to previously printed products is not guaranteed unless a specific color-matching process has been quoted and agreed to in writing.
If you require an exact or closely controlled color match to a previously printed product or specified color, please request a quote for the appropriate color-matching or proofing method before approving production. Pricing and available methods vary based on the product and printing process.
As the Client, you are responsible for reviewing the final proof carefully and confirming that all content and specifications are correct before approval, including spelling, grammar, names, phone numbers, addresses, dates, URLs, QR codes, quantities, folds, finishing, personalization and other order-specific information. You are also responsible for the quality and resolution of client-supplied images, logos and artwork. Approval of a proof is final authorization to produce the order as shown. One Step Services is not responsible for errors or omissions that appear in an approved proof or for changes requested after production has begun. Changes after approval may require additional design, production, material or vendor charges. The most recently approved proof supersedes prior proofs, comments and versions for purposes of production.
Product Pricing
Published and quoted prices for products and services are subject to change without notice until an order is accepted. Quotes are based on the specifications and information available at the time they are prepared and may be adjusted if quantities, materials, production requirements, mailing data, postage, shipping, taxes, vendor costs or other order specifications change. The quantity ordered and paid for may exceed the quantity ultimately mailed because duplicate addresses, invalid or undeliverable addresses, suppression requests, postal processing results and other list-processing factors may reduce the final mailable quantity. Unless otherwise expressly stated, a reduction in the final mailable quantity does not create a right to a refund or credit for printing, processing or other work already completed. Sales or use tax will be charged when required by applicable law. Postage, shipping and other pass-through charges are subject to the rates and requirements in effect when the order is processed.
Delivery of Products
One Step Services will use commercially reasonable efforts to deliver completed orders to the United States Postal Service ("USPS") or another third-party carrier, as applicable, within the estimated production schedule. Delivery dates provided by USPS, shipping companies or other third-party carriers are estimates unless the carrier expressly provides a guaranteed service. To the fullest extent permitted by law, One Step Services is not responsible for delays, loss, damage, misdelivery or other delivery failures occurring after an order has been accepted by USPS or another third-party carrier, except to the extent caused directly by One Step Services.
Letterhead and Envelope Printing
Uncoated and absorbent papers used for many letterhead and envelope products reproduce ink differently than coated papers used for products such as postcards and business cards. Images may appear softer and colors may appear different from what is shown on a monitor or from the same artwork printed on a coated stock. Minor variations in color, ink coverage and appearance may also occur within a production run and between separate orders and are considered normal characteristics of commercial printing unless otherwise agreed in writing.
YARD SIGNS/LARGE FORMAT PRODUCTS
Our 90 day guarantee covers manufacturing defects in the product. If a product fails during the 90 day period due to a verified manufacturing defect, One Step Services will repair or replace the affected product at our discretion. One Step Services reserves the right to inspect the product and determine whether the condition is the result of a manufacturing defect. The guarantee does not cover ordinary wear, improper installation or handling, misuse, vandalism, vehicle or equipment damage, exposure beyond the intended use of the product, high winds, severe weather, natural disasters or other conditions outside our control. To the fullest extent permitted by law, no other warranties, express or implied, are made except as expressly stated in writing.
DESIGN/CREATIVE & ARTWORK FEES
Design, creative, production set-up, artwork preparation, file correction, revisions, prepress and other production-related services may be subject to additional fees. Client-submitted artwork is not presumed to be production-ready. If submitted files require review, adjustment, resizing, correction, rebuilding, conversion, image or font preparation, color adjustment, file repair or other work in order to prepare them for production, applicable artwork or production fees may be charged. All such fees are based on current pricing in effect for the applicable product or service and may vary depending on the scope and requirements of the order.
Mailed Orders
Mailed orders may be subject to postal processing, mailing preparation, data processing, list or database setup, addressing and other mailing-related fees in addition to applicable design, artwork, printing, postage and delivery charges. All fees are based on current pricing in effect for the applicable product or service and may vary depending on the requirements of the order.
All artwork that is ordered and subsequently canceled or put on hold after typesetting, design, data processing, production preparation or other work has begun is subject to accrued design, production, vendor and other nonrecoverable charges incurred through the date of cancellation or hold.
For tracking purposes, we add two additional mailing pieces called "seeds." One is sent to our office and one is sent to your billing address, both at the same postage class as the rest of your order. If you have provided a different seed address, your piece will be sent there. Seed pieces are intended as a mailing reference only and do not establish or guarantee the delivery time of the remainder of the mailing.
USPS Delivery
One Step Services acts as the preparation and mailing agent for direct mail orders. We cannot guarantee delivery to any particular recipient or guarantee USPS processing or delivery times. Documentation showing acceptance or entry of a mailing into the postal system is retained for mailed orders when available and may be provided upon request. Such documentation confirms entry of the mailing and is not proof of delivery to each recipient. Time-dated or time-sensitive mailings cannot be guaranteed to arrive within a specified period unless a separate guaranteed delivery service has been expressly arranged. Mailing by bulk, marketing or other non-guaranteed postal services is at the Client's risk as to delivery timing. One Step Services will not be responsible for reprinting or remailing an order at our expense solely because of USPS processing delays, delivery failures or damage occurring after USPS accepts the mailing. Carrier-related damage may include scuffing, cancellation ink, smears, tears, folds, markings and other handling damage caused during postal processing.
Exemption Certification
Certain mailed printed materials may qualify for an exemption from sales or use tax under applicable state law when the requirements of that jurisdiction are met. By formally approving your design proof and authorizing One Step Services to proceed with a mailed order, you certify, to the extent applicable to your order, that the printed materials are being purchased as printed sales messages or other qualifying mailed materials, and you authorize One Step Services to act as your agent in the acquisition, preparation and mailing of those materials through the United States Postal Service or common carrier, as applicable. You further certify that the materials will be delivered as directed by you to recipients at no cost to those recipients who become the owners of the printed material. Your electronic proof approval, together with the applicable order and proof records, is intended to serve as your written certification for the transaction where such certification is permitted by applicable law. If any printed material is delivered or used in a manner that does not qualify for an applicable exemption, you understand that sales or use tax may apply and that you are responsible for any tax required by law.
**Eligibility for any sales or use tax exemption varies by jurisdiction and by the nature and delivery of the printed material. For orders subject to California law, qualifying printed sales messages are governed by Regulation 1541.5 of the California Sales and Use Tax Regulations. If an order or any portion of an order does not qualify for an applicable exemption, One Step Services may charge the appropriate sales or use tax.
Copyrights and Client-Supplied Content
By submitting or approving photos, images, logos, trademarks, text, fonts, artwork, data or other content for use in an order, you represent and warrant that you own the content or have all permissions, licenses and other rights necessary for One Step Services to reproduce, modify, print, distribute, mail or otherwise use the content as instructed by you. One Step Services is entitled to rely on your authorization and is not responsible for determining ownership or clearing third-party rights in client-supplied content. You are responsible for claims arising from content supplied or directed by you and agree to defend, indemnify and hold One Step Services and its affiliates, employees, agents and service providers harmless from third-party claims, damages, costs and expenses arising from the unauthorized use of such content, to the extent permitted by law.
Unless otherwise agreed in writing, One Step Services retains its rights and interests in working files, native production files, templates, production methods and original design concepts created by One Step Services. Client-supplied content remains the property of its respective owner. Final native or editable production files are not included with printed or finished products unless specifically included in the applicable quote or agreement.
Security of Data and Storage
You are responsible for maintaining backup copies of artwork, mailing lists, databases and other materials supplied to One Step Services. We use commercially reasonable administrative, technical and operational measures to protect information in our possession, but no method of electronic transmission or storage is completely secure and we cannot guarantee absolute security or uninterrupted availability of client files or data.
If you provide mailing lists, recipient information or other personal data to One Step Services, you represent that you have the lawful right and authority to provide that information and to instruct us to process it for the requested services. One Step Services may process and disclose such information to employees, affiliates, vendors, service providers, postal providers and carriers as reasonably necessary to produce, fulfill, mail, ship, support or administer the order. You are responsible for the accuracy and lawfulness of data supplied by you.
Electronic communications, including email and website transmissions, may not always be encrypted. Client files and data may be retained for operational, legal, backup or recordkeeping purposes and may be deleted in accordance with our normal retention practices. One Step Services does not guarantee indefinite storage of client files, proofs, artwork or mailing data.
Limitation of Liability
To the fullest extent permitted by law, the total aggregate liability of One Step Services arising from any product, service or order will not exceed the amount actually paid to One Step Services for the portion of the order giving rise to the claim, excluding postage, shipping, taxes and other third-party or pass-through charges. If One Step Services determines that a product contains an error or defect for which One Step Services is responsible, our obligation will be limited, at our option, to correcting or reprinting the affected product or refunding the amount paid for the affected product, subject to applicable law.
To the fullest extent permitted by law, One Step Services and its affiliates, agents, employees and service providers will not be liable for lost profits, lost business, lost data, loss of goodwill or any indirect, incidental, special, exemplary, punitive or consequential damages arising from or relating to any product or service, delay, third-party data, website, email service, carrier service or inability to use a product or service, regardless of the legal theory asserted and even if advised of the possibility of such damages.
Some states or jurisdictions do not allow certain limitations or exclusions of warranties or damages. In those jurisdictions, these limitations apply only to the maximum extent permitted by applicable law and do not limit any rights that cannot legally be waived.
